Income Guidelines as of March 18, 2009

FINANCIAL ELIGIBILITY GUIDELINES

INCOME

We have established a maximum income level for different family sizes which is 125% of the Federal Poverty Guidelines as reflected in the table below. These numbers are the maximum levels. We can waive up to 200% in unusual or meritorious circumstances when certain factors are present for consideration.

WHAT IS CONSIDERED "INCOME"

Every source of income is to be used in determining eligibility, with some exceptions:

  • Food stamps
  • Housing vouchers
  • Tax refunds
  • Funds withdrawn from a bank account
  • Gifts
  • Compensation and/or one-time settlements for injuries sustained
  • Any other non-cash benefit
GROUP REPRESENTATION

We may provide legal assistance to a group, corporation or association if it is primarily composed of persons eligible for legal assistance under 45 CFR Part 1611 and it provides information showing that it lacks, and has no practical means of obtaining, funds to retain private counsel.

VERIFICATION OF INCOME

In certain instances, if it appears necessary to verify an applicant's income, requests for the previous year's income tax returns, bank statements, etc., can be made.
